In Germany, EULAs have to adhere to a larger body of laws (civil code, trading laws), and those rights cannot be changed.

For example they inculde, that, if the Terms of Service are changed, the customer /has to be notified/, or the contract is a) null and void, and b) the customer can press for charges.

The MS EULA has not been tested in court yet in Germany.
