but wouldn't the paint still be paint...even if some of it has dried up? Isn't the old gas in the gas can still gas...even if it is not as flamable? Degraded or not they still pose a *potential* toxic threat.

To draw another analogy: If a convicted felon on parole is found to have an old and rusty, but still somewhat functional Loaded pistol under his bed, and he is specifically forbidden to have a firearm in his possession... does that constitue a violation of his parole?
