I am a 54-year-old man.
A previously unknown to me 16-year-old female approaches me and hands me pictures of herself in "explicit" poses.
(or I browse to a public - non-pornographic web site like MySpace)
Current US Law defines a person in an "explicit" (or pornographic) situation as a "child" if they are less than 18 years old.
Do I now have illegal child pornography in my possession?
Can I be charged with possession of child pornography?
Why?
Can I be let off because the pictures were TAKEN by a child?
Why not?
Is the *creation* of child pornography a crime?
By anyone?
Who's exempt?
Why?

Now for the sixty-four-thousand-dollar question: How young is too young?
