I'll go with Dorfl's idea here and say that Atheism is a religious position to the extent that it is a religion. The religion is that there is/are no god(s). They don't so much not believe in going to church as believe in not going to church. Therefore, forcing a child who was raised atheist to go to church is pointedly dumb.

A child in the Roman Catholic church has the choice after they've turned eleven to say hang the church, I'm going to believe in no god. In that case, this kind of custody ruling becomes ridiculous, but only then.
