That's how custody cases are decided by default. Just like you don't hear that a jury was picked for a trial ... that's just how it's done.

And if the judge felt that the kid going to church was in the kids best interest, more so than spending the time with his father, then the judge was right to do so.

If he had it out for the father because the father was an aethist, that's something else.
