From a legal point of view, the welfare of the child outweighs parental rights.

Was the judge unfair? Possibly. We don't have the court information to make a determination on that.

Whether it was fair/unfair is besides the point. That makes it a contest between the mother and the father, which it isn't.

The welfare of the child should be the deciding factor, regardless of the rights of the parents.

If based on THAT, the judge felt this was the right decision, then there's nothing wrong about this at all.
