The monitored communications were international so the expectation of privacy decreases. Both the courts and congress were aware of the order and neither moved to block it. So was the order in violation of the Constitution or not? Being an originalist I say yes. However, the courts apparently have a different view. In the end the judicial interpretation is the standard by which his action should be judged.
