There's a stipulation to that "percentage	by rorajoey	2005-11-29 15:55:21
of the work used" clause. IIRC, if you use only a small percentage of the work, but that portion happens to be the heart or essence of the work, it would not fall under Fair Use. I don't think that would apply in this case though.
