is something different, and can be in violation of policy. Assuming that qualified people of that ethnicity have applied and not been hired (also assuming those who were weren't More qualified), someone is violating policy. When the company finds out, that person's job is in jeopardy.

Also, when that happens, lawsuits are nearly inevitable, so lack of lawsuits is a pretty good indicator that policy is Not being violated. The opposite is not as true, as some people will sue for imagined slights.
