Part 2 and part 3 help keep Apple control over the software. If you're not allowed to distribute it or install it on multiple computers, then Apple can prevent anyone from installing a given version of QuickTime by simply removing it from their website. That won't help already installed copies, but at least it will be phased out. The bit in part 3 about being allowed to transfer all the software is just the "doctrine of first sale". They can't deny you that under US law, so they explicitly grant it.
Part 9 is probably also in there due to US law. US law won't let them export to those countries, but of course it is impossible to prevent using technology, so instead they put this in the licence agreement. Obviously this probably won't stop anyone in the embargoed countries from downloading, but at least Apple has a legal defence in case the DOJ comes after them.
As for the rest, I've been referring to non-free software as "evil and proprietary" for a while (I don't use it anymore either). It seems to be catching on amongst my flatmates :-). |
