they make a distinction between a lawfull order and an illegal order. Soldiers use their own judgement to determine which is which, and act accordingly.

That's the way the Canadian military works anyway. If I am ordered to execute a prisoner, not only do I not have to follow that order, but it is my duty to NOT follow it, to prevent others from following it, and to report it up the chain. I'm no expert on the US military legal system, but from what I've seen it seems to work the same way.
