then it is "deep linking" and perfectly legal. IF however he copies the images to his own server and loads them from there he may be stealing copywritted images.

To summarize stealing bandwidth is legal, stealing copywritted material is not. You can have two pages that look perfectly identical, but because has an img src=OtherWebSite and the other has img src=LocalButStolen one is legal but the other is not.
