| If you have an outstanding arrest warrant, any officer is obliged to bring you in if they encounter you. Doesn't matter if there are extenuating circumstances. Yes, it sucks when otherwise good people get harassed. If you are driving 70MPH, and have outstanding warrants, you should be taken in. That is the law. If you are driving 70MPH and get pulled over and have no outstanding warrants, you get a speeding ticket and go on about your business. That is also the law.
If you have a specific thing that is "criminalized" that shouldn't be, talk to the appropriate elected official to get it changed. If you have be injured by such a thing, go through the courts and have the law invalidated or the abusive person punished. There is a reason the US still has jury trials in both civil and criminal cases. |
