"Separation of Church and State" is one of the most misunderstood and often quoted things by most people. I'm looking for actual leglislative, Constitutional, or judicial fact to back up or refute the positions (either way).
I would venture to say your simple "you may be Church, in which case you're not State" doesn't even come close to the issue. The Constitution does not say there is a separation of Church and State, it provides that "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;", which is a very different thing. The Constitution does not address any other interactions between other parts of the Government (Executive or Judiciary) and religion.
If our traditions are any indication, Church and State with the executive branch are intertwined - what book do you think the President has his hand on when he takes the oath of office (hint, it is NOT the Constitution)? In fact, according to clicky, President Washington kissed the Bible after the swearing in ceremony. |
