The courts have... by jdelphiki 2005-03-22 11:29:39
...ruled in favor the testimony of her husband and friends, as you point out. That should provide the legal standard by which the husband's wishes can be carried out.

But my point is that there are no hard-and-fast legal guidelines to follow when it comes to questions over biological vs. legal rights.

How many legal adoptions have been overturned because the biological mother (or sometimes, even the father) has changed her/his mind and decided to take their baby back? How many legal, written-down wills have been successfully challenged by the family in court because of the perception (true or not) of duress or other manipulations by a spouse?

Add to that the confusion in the courts over whether or not the death penalty is legal and appropriate and the years of conflict over the question of whether the beginning human life should be defined legally, or biologically.

I'm not trying to argue that Terri Schiavo is or isn't in PVS or whether or not she should be allowed to die. My own feelings on that are meaningless because it's not my decision to make and because I have not been privy to all the information presented by both sides. And I haven't seen her. Without that info my own feelings are based on incomplete information.

But I DO believe that our country has not done enough to define the specific criteria in determining how to handle situations like these. It really shouldn't be this hard and it shouldn't have to get this ugly.
