that they don't know at that point that any law is being broken. It is legal to drive after being in a bar, and even after drinking, just not after drinking enough to become legally drunk. Unless the driver is clearly impaired in his driving, and he would have to be pretty well sloshed to be visibly impaired just pulling out of a parking lot, they lack probable cause to pull him over.
Besides, bar owners raised fits any time cops tried it. They claimed harassment, and had a good enough case that cops are leary about doing it any more. |
