I agree that the guesser didn't actually guess, so it was cheating.

However, the other person should never have agreed to this if he wasn't prepared to pay up in case of a correct guess. "You couldn't have guessed that".

... Right, so that's why you agreed to give the prize.

A correct guess might have been improbable, but it was not impossible.
