I feel that punishment should fit the crime. If you kill someone it's different from being inept with the weapon. Yes, the intent should be taken into consideration, but the punishment must be different in both cases. Similarly in abuse cases. Look at what happened, and act accordingly. In a family when a child breaks a curfew by 5 minutes, the punishment is usually less then if he/she breaks the curfew by 5 hours.
