Should a sentance reflect the damage done by McGowan2005-02-27 08:12:51
Firstly, I know of nobody who was molested as a by NOLAWitch 2005-02-27 08:31:35
child who grew up to be a "normal" adult with no issues whatsoever. Sure, in the first example, the girl may appear to be "normal" (whatever that may mean; there are some so-called "normal" people on this board who are scary as hell), but she has underlying issues that she may be coping with better than the girl in your second example. The fact that the situation could go either way and the molester had no guarantee of a "good" outcome (i.e. one in which his victim wasn't seemingly incapacitated in the long-term) should determine the sentence for such a crime.

Just as there is a harsher penalty for committing a robbery with a firearm than without one due to the possible harm that could ensue, there should also be a harsher penalty for child molestation regardless of demonstrable harm.

The man who pulls a gun, shoots and it misfires should be charged with attempted murder yes because except for his ineptitude with the weapon, that was his goal.
