See if the phones they have in the store have the newer firmware. As soon as they do, return your phone because it's defective (games don't work), and swap it for a new one. Don't let the store people know you know anything about firmware versions, as that'll just scare and confuse them. Stick with the simple "your store model works, my phone doesn't (and never has), so I want to trade", and you should do ok.
