A criminal becomes such by virtue of the act, and by virtue of its having been declared criminal.

The notion of "apprehending a criminal before [any] crime is committed"
amounts to a kind of "thought police". But I suppose that you would
like to live in the world depicted in "Minority Report", and are loony
enough to think it a utopia!
