Discovering a network is insecure is on the same level as noticing their garage door is open from the street - it requires no more intervention than 'looking' in their direction, and their AP is literally advertising its presence.
Actually using that AP would be akin to going into their garage and rummaging around in it. Notifying them would be akin to knocking on their door and letting them know - you still have to enter their property to do so.
