the circumstances we are discussing here.. are in Peaceman's post.. and I quote:

"You walk by my house. I have planted roses in my front yard and not put up a fence."


He did not say they were outside of his property. Though he did not say they were entirely inside the property either - it seemed pretty clear that by referring to the lack of a fence his intent was that you could see and smell the roses because of its absence...

you went further and added you touched them. Some rose garden enthusiasts would be screaming bloody murder if you started to handle their roses - and if you leaned over their property or entered onto it to touch the roses you would be in trespass.
