It isn't illegal (yet!). But it might very well be unethical. Depends on your ethics, I guess.

Personally, I would not set up to use a neighbour's wireless connection if I happened to stumble on it. I would probably connect to it enough to see who the provider is, and how fast it is, but that is all.
