you may not be taking a physical item from someone, but you are using their equipment to get access to a service, that has to be paid for, for free. You also aren't paying them for it, and there has been no statement saying "this is an open network to one and all". Your statue analogy doesn't work, as you can look at a wireless network in passing (aka war-driving) and say "hey, there's a wireless network". If you were to use it, it would akin to taking the guys statue because you liked it and wanted it for yourself. Now, if you wanted to drop a fiver to the guy each month for accessing HIS network, use HIS access point, HIS cable or dsl service, then that would be ok, provided the person was ok with it.
