I honestly think the classical terms of property, theft, etc. don't work in connection with immaterial things like a wireless signal, light or sound. I agree that my analogy was also too simple, but I wanted to show that conventional legal terms just don't apply here.

As for it being theft, doesn't theft imply that you have less of something after I take it? If you payed for a statue, and put in your front yard to look at it, am I stealing the view if i als0 look at it in passing? Obviously, if I'm standing in your way, and you can't see you statue because of me, then I'm being impolite and you're right to send me away (analogy to maxing out someones bandwidth while he's trying to get his mail).
