Why do law professors think by niwikki 2004-12-15 11:15:05
that in order to show you have an understanding of the topic you should be able to apply new facts to the existing law without ANY outside reference materials (with the exception of a book of statutes)?

In the real world, you have reference materials. In the real world, you can refer to your notes.

What this does is it prevents people who understand concepts but don't memorize well from fully displaying that they understand the concepts, because they are spending their entire time desperately trying to remember which factors they're supposed to analyze rather than analyzing those factors.

This should be my jihad for the week ---

All law school exams (and the bar exam) should be open book / open notes. Any professor who disagrees is a POOPYHEAD.
