The state has been given the power to kill as punishment for committing fitting crimes. This power (and list of crimes) comes from the people as a whole, while the people as individuals do not have this power, according to society. Errors do get made in the use of this power; unfortunately there is not much that can be done afterwards for the executed. What can be done is to adjust the system so that similar mistakes do not get made again.

Morally, if you are not in jeopardy you cannot justify killing another. At the individual level, this is one of the times where legal and moral match, assuming the current common morality.
