I'm wondering what it will take to get a major court trial of the whole concept of the shrinkwrap, non-negotiable EULA being a valid contractual obligation, etc. Anyhow, either way, it's scummy and over-bearing practice... (I'd like to see, say the automotive industry, try something similarly non-sensicle. There'd be open revolt. (The publishing industry has tried it several times).
