...capital murder applies to murder that involves any of a predefined set of mitigating circumstances. In Kansas, I believe the list includes multiple murders and murder involving rape and/or children.

That's not the complete list, but the general idea is that a capital murder represents a more serious threat to society or a more serious abrogation of society's greater good.

Not that I necessarily agree with the list or the law as it's currently defined. I believe that there can be cases serious enough to be considered as capital crimes, but I'm not sure that a laundry list standard is the best definition for them. And to be honest, I'm not sure if there really IS a fair way to create a set of laws that would adequately reflect my beliefs on the death penalty. The risks of the justice system getting it wrong, and the difficulty of coming up with an appropriate standard to follow may just be too hard to come by.
