has less (or no) value through his actions. By definition, murder is not excusable under any circumstances.
The life of the victim is always more valuble than the attacker's. One can argue about the size of the difference if you want, but there is always a difference; unless you reject the norms of society in this concept.
While some death sentances are wrongly applied to cases with too much circumstantial evidence, there are many cases where the evidence is so overwelming and so clear that the guilt of the accused is not in question even to a sixth grader.
