...my analogy is probably pretty sucky.

And because not all loss of life caused by others is equal. If it were, the law would not distinguish between accidental death, involuntary manslaughter, voluntary manslaughter, premeditated murder and, of course, capital murder.

The guidelines for capital murder are set with deterrence and/or punishment in mind, either to protect society from $EvilBadPeople or to punish $EvilBadPeople for crimes so anti-social that society is better off without them.

Whether or not those "lofty" goals are attained for society by the current, or any projected, laws is debatable.
