My father was killed in a steel mill when a co-worker accidentally activated a crane that Dad was working on. The co-worker did not know anyone was in the danger zone and the safety equipment that should have warned him malfunctioned. It was a regrettable accident and one that still hurts me badly. But I cannot call this man a murderer. I'm not angry with him and I never wanted to see him punished.
Had Dad been killed in cold blood by a gunman, yes I'd be angry. And you can bet I'd want to see the killer punished.
Correct me if I read you wrong, but it sounds like you'd equate both scenarios. My father is dead either way. Yet I can see a difference.
Death is not always murder. There are shades of grey. Punishment should fit the crime and sometimes that means identifying the intent of the accused. That can be a difficult task and is arguably the root of our jury system. A dozen men and women must be convinced before a verdict of guilty can be handed down. The appeal system exists to minimize the number of false positives. It isn't a perfect system, but it's pretty darned good. |
