| Indeed, the random and unplanned nature of the killing in this hypothetical case makes it more likely that I will deprive another human of life, especially if I knowingly failed to employ some reasonable precautions (such as not driving drunk).
Although I should admit at this point that I agree that intent is important in determining sentence. Just wanted to ensure that the victim's loss of life isn't overlooked.
But, uh, that makes a drunk driver more likely to kill and kill again (as opposed to a murderer who may not be driven to the extremity of killing again). Who truly desserves the harsher sentence? |
