but your example of an accidental death is flawed. The death penalty is not supposed to deter such an occurrance (notice I do not call it a crime, though some other crime such as negligence may be involved).
Those who use the deterrence argument are talking about premeditated murder. It MAY be a deterrent for a few cases, but IMO, not enough to make it a valid justification for the death penalty. And in a crime of passion, a murderer probably isn't going to be thinking clearly enough to consider the consequences of his act.
Does anyone have a statistic on percentage of murders as crimes of passion compared to premeditated? |
