Two, there is no indication of grief.

If the accused is innocent he may be demonstrating rage at the injustice, which is interpreted as insensitivity. In Texas there are documented cases where the police, prosecutors, and judges conspire to convict, and then the accused is supposed to act sorry that he did it.
