lane 1. I'm aware that practicalities mean that it's not always a clear-cut case.

I've only ever seen that kind of situation when the people in lane 3 were doing the full limit (or more), in which case no-one* should be trying to overtake them, so that STILL leaves no-one who should be changing lanes to let people past; or when the traffic was jammed up and everyone was crawling (in which case lane-changing rules tend to fall apart anyway, and Eris help any emergency vehicles trying to get through). I'm not going to pretend to know whether the overtaking lane rules change in jams, because what people actually do is more significant to me getting to my destination in one piece!. ;)

Anyway, I believe that the pedantic answer is that you shouldn't have pulled out into lane 3 in the first place unless you knew there was a suitable gap to pull back into 2 after a small number of cars. And the main point I was after was the "don't change lane to let people pass", not the "don't travel in lane 3", even if I did make the latter. =)
