Take away one or the other offending action. Would she have been considered to be doing something dumb if she had hit her brakes and SnARL was doing the speed limit? No. People use their brakes all the time -- thats what they're for. Now, if she didn't tap her brakes and moved out of the passing lane, would SnARL still have been doing something dumb? Yes.

That reasoning right there is the basis for assessing fault in insurance cases. Her actions are irrelevant in the face of his overwhelming disregard for the law.
