IF she was deliberately trying to screw with him, she has a small degree of fault. In an ordinary situation, I would want to smack the snot out of her.

But we don't know that she was doing that deliberately. We only have his word, and at 120 MPH he probably didn't take in a meaningful amount of detail about her appearance to give trustworthy judgement.

It's clear, however, that _he_ was a sudden and imminent danger to everyone else. He deserves punishment.
