Tailgating is clearly the worse offense. "Tapping" the brake often implies just enough to get the lights to come on, thus warning the jerk behind you to back off before he kills someone.

That jerk behind you is the one who will cause the accident. You _have_ to have some safety zone between the cars in case you have to SLAM on the brakes.
