"Separate but equal" refers to segregationist dogma that was used to justify separate white/black schools, restrooms, drinking fountains, bus seats, etc. It has absolutely nothing to do with creating hierarchal classifications--or do you think that it is wrong to differentiate between breeds of dogs? Or between flavors of soda? Ice cream? Coffee blends? Do you mean to say that simply referring to someone as Black or Hispanic creates a "separate but equal" situation?

Let's put it in code terms. Currently the Law object has a CivilUnion() method and a Marriage() method. CivilUnion() is used infrequently due to inconsistent implementation across states. So most states use the Marriage() method instead. Marriage has two parameters: a Man object and a Woman object.

Now let's say you want to implement a more robust CivilUnion(). Most of the code you want is already in Marriage(), so we just move that code into CivilUnion() and turn Marriage() into a wrapper for CivilUnion(). Now the government is free to implement other wrappers for male/male and female/female civil unions.
