Sale of the software media without information necessary for registration is "copyright infringement" in the USA and Canada. I would expect that to hold true in Europe, as well.

Penalties may be up to $100,000 per incident.

Seems to me it would be much cheaper for him to refund the total (price+shipping) and simply ask you to destroy the CD and mail a small indentifiable piece of it back to him (what's that going to cost, a buck?) to avoid possible costly legal defense against $BIG_SOFTWARE_COMPANIES'_LAW_FIRMS (even if he wins, it will cost more than $50).

But perhaps he's an idiot.
