I don't recall that - it's not specifically stated in the Constitution, and I don't believe that such a case has ever come up before the Supreme Court; in any case, since they are required to abide by the Constitution (as amended), it doesn't seem that they can choose which part of the Constitution to ignore.

Re the second paragraph: I understand that, thanks. My question was meant to include the entire process of ratifying the amendment.
