I could be very wrong, though.

Literally, a "legal incident of marriage" is a marriage that is considered legal in some jurisdiction. Thus, not a "civil union".

It seems like it's making a provision to prevent any marriages that are okayed in one jurisdiction (whether in or out of the US) from being forcibly honored by any other US jurisdiction.

It's still a load of horsecrap, but it doesn't seem to prohibit civil unions.

Also, absolutely no justification for the rule is offered in the text itself - we can only go by what we know of the discussion and the discussers. And Santorum is a raging homophobe and fundie Christian, so...
