It's a decision. One has to decide
a) whether "no punishment without offense" is a sensible guideline or not
and
b) whether it's feasible to introduce a new kind punishment that was not in place when the offense was committed.

Most legal systems say "yes" and "no", even though that is not very handy when it comes to crime prevention.
