At what point are we allowed to put someone to death? There are plenty of convicted murderers who are _not_ on death row in state's that allow execution. Why is that? Because we set the bar higher.

That was just an extreme example, of course. But there are many areas where the judge is allowed to make incredibly intrusive decisions regarding our privacy and other rights. If those were generally unreasonable, we'd have had a revolution by now.
