I company has two chices in protecting IP. Trade Secret XOR (exclusive OR) Patents. One cannot apply for a patents and then, failing the process, use the trade secret laws. This is precisely because patent applications are public documents. The minute you apply for the patent the trade secret cat is well out of the bag.
