I suggest that you find a lawyer, or simply file the 35USD fee and let the judge decide. Go for the max (about 3000USD) and let the school sweat how to answer it. If you go this route then say nothing more to them until you are in front of a judge.

The paperwork is a bit intimidating but rather short. If you are at all uncomfortable with it then get a lawyer's advice. Note that, neither party is allowed an attorney in small claims court. But, that does not stop either party from getting a lawyer's advice.
