I only read the article you linked. In the introductory paragraph, they said his claims of mental retardation were rejected. I take that to mean he wasn't denying having pulled the trigger, just about being responsible for the murder. It should go without saying that I wouldn't convict the man in question based on my interpretation of an article's blurb. I was just answering your question in the context you raised it in (here's the story, what if he is telling the truth).

I agree that the proof of the crime needs to be as stringently defined and scrupulously adhered to as you suggest - I just don't agree with anyone that mentally retarded people are less punishable for capital offenses than mentally competent people.
