I agree that the bar needs to be set high, I just disagree with your statement of what should be necessary.

I think the death penalty should be reserved for cases which can be proved beyond a shadow of a doubt rather then just beyond reasonable doubt. Cases where the perpetrator was caught in the act, and cases with multiple reliable eyewitnesses (excluding those testifying as part of a deal with prosecuters)and ample physical evidence should qualify. If DNA evidence could clear someone, it should Have to be evaluated.

Oh, and just because this guy claimed innocence to the end doesn't mean he was really innocent.
